Terms
The plain-English terms for working with Banksia Web.
Last updated 30 October 2026
1. About these terms
These terms apply when Banksia Web (“we”, “us”) designs, builds, refreshes or looks after a website for you. Your written quote sets out the details of your project.
By accepting a quote or paying a deposit, you agree to these terms. If your quote says something different to these terms, the quote applies.
2. Quotes and pricing
Every project is priced by quote, so you only pay for what you need. Your quote lists what is included, the number of pages, the rounds of changes, the estimated timeline and any third-party costs.
Quotes are valid for 30 days. Anything not listed in your quote is extra, and we will always quote it and get your OK before we start.
3. Payment
- Deposit: 50% of the quoted amount is due when you accept the quote. We book your project in once the deposit is paid.
- Balance: the remaining 50% is due on launch, when your website goes live.
- Refresh work is quoted per job, or charged by the hour at the rate in your quote, and invoiced when the work is done.
- Website Care is billed monthly in advance.
- Invoices are due within 14 days.
If an invoice is overdue, we may pause work, or pause Care services, until it is paid.
4. Rounds of changes
A round of changes is one combined list of feedback on the preview we send you. Your package includes:
- Seedling: 1 round of changes
- Bloom: 2 rounds of changes
- Banksia: 3 rounds of changes
Extra rounds, or changes to the agreed scope (such as new pages or features), are quoted before we start them.
5. Your content and approvals
- You provide your logo, photos, text, service details, booking links and anything else listed in your quote. We will agree on dates for these at the start.
- You confirm that you own, or have permission to use, everything you send us, and that it is accurate and lawful.
- You are responsible for checking the preview, including your business details, before you approve it. Once you approve it, we go ahead with launch.
- If a project is on hold for more than 30 days waiting on content or feedback, we may invoice for the work done so far and pick it back up when you are ready.
6. Timelines
Your quote includes an estimated timeline. It depends on receiving your content and feedback on time, and we will keep you updated if anything changes.
7. Hosting, domains and third-party services
Your website relies on services from other companies, such as your domain registrar, web host, booking platform, email provider, plugins and fonts. Their fees are separate unless your quote or Care plan includes them, and their own terms apply.
We are happy to help you set these up, but we are not responsible for outages, price changes or feature changes made by those providers. We recommend your domain is registered in your own or your business’s name.
8. Website Care plan
- Care is month to month, with no lock-in contract.
- It includes what is listed in your Care plan, including up to 30 minutes of small changes each month. Unused time does not roll over.
- You can cancel any time with 30 days’ notice by email. If your hosting is included, we will help you move your website to a new host.
- We will give you at least 30 days’ notice of any change to your Care plan fees.
9. Ownership and intellectual property
Once you have paid in full, you own your website: we transfer to you our rights in the design and content we created for your project. Until final payment, we keep ownership of that work.
You keep ownership of all content you supply to us. Themes, plugins, fonts, icons and stock images remain owned by their creators and are licensed to you under their own terms.
We may show your website in our portfolio, unless you ask us not to.
10. Liability
We take care with every website, but we cannot guarantee that it will always be error-free or available, or that it will reach a particular position in search results. Please keep your own copies of your content.
Nothing in these terms excludes, restricts or modifies any rights you have under the Australian Consumer Law. To the extent the law allows, our total liability for any claim about a project is limited to the amount you paid us for that project (or, for Website Care, the fees you paid in the previous three months), and we are not liable for indirect or consequential loss, such as lost profits or lost data.
11. Ending a project
Either of us can end a project by email. If that happens, you pay for the work done up to that date. If we end a project for a reason that is not caused by you, we will refund any amount you have paid for work not yet done.
12. Governing law
These terms are governed by the laws in force in Australia.
